After becoming thoroughly aware of the considered patent(s), IXAS Conseil considers the geographical relevance, checks the payments of the annual installments and the patent(s) validity and carries out an in-depth analysis of the range of coverage of the patent(s) claims in relationship to the claims of other possible patent(s) relevant to the considered sector. This comparison implies, to a great extent, to test the solidity of the patent(s) with a view to possible bypass. This implies to extract, from international data banks, the closest patents, and to include/understand as much as possible the competitive technologies or alternate products which may be possibly also protected.
In parallel to this analysis of patent(s), IXAS Conseil appraises the business opportunity, this expressed in term of strength of the market need, in a competitive situation, satisfaction of the market need brought about by the considered protected solution, long term trends supporting the need, of value of the improvement brought about by the proposed solution, of clarification of long term sustainable competitive advantage, and of factors allowing to create a satisfactory competitive opening in the considered geography.

Starting from a mix of financial criteria such as turnover already achieved or achievable, growth potential, quality of business expressed in gross margin and existing or likely return on investment, investment in R&D and intellectual property rights protection already carried out, size of investment of future production, investment to come in order to cover for the future R&D developments and for the protection of these developments, IXAS Conseil positions the value of the patent(s) in terms of range of percentage of the likely turnover and in terms of absolute value according to the type of technology or and field considered. This leads to an estimate of the possible return of license and royalties.
